Indian Laws refer to the constitutional laws of the nation India. Usually, we skim through constitutional laws and articles in our college or school for the sake of exams. But, when it comes to social and judicial interactions we often find ourselves wondering what are the laws and rights as an Indian citizen that one can exercise. We just try to recollect whatever we remember from all the past studies and instances. But that might not be completely helpful. So, here I have compiled a list of ten Indian laws that every young Indian must know so that you don’t have to embarrass yourself in public and even get out of jail in critical situations.

  1. The law for PDA
    PDA which means Public Display of Affection is limitedly allowed according to Indian constitution. But we often find that people are getting arrested for PDA. Well, according to constitution holding hands in public, hugging and kissing is not a crime but according to section 294 of IPC it is illegal to go beyond hugs and kisses and any act of intimacy is a punishable offense.
  1. Right to Privacy
    One of the most important Indian Laws is Right to privacy under article 21 states that you can reject to disclose your private information like names of parents, their contacts, your phone number and other private information in public unless you have commited a serious offense. So next time if some authority pointlessly asks you to disclose your private information. You can choose to reject and convey it respectfully that it’s your constitutional right to privacy.
  1. Force and Assault on a Public Servant
    According to section 353 of IPC Assault and criminal force to deter a public servant from discharge of his/her duty is a punishable offense with imprisonment, or with fine, or both. So, never get into heater argument with police or any government officials. They might get you arrested with a reason that you did not allow them to perform their duty hence proving you gulty. This is a non-baleble offense and you’ll have to obey the verdict of court unless you proven not guilty.
  1. Marrying by choice
    According to article 21 of Indian constitution the right to marriage is stated under Human Rights Charter. The right to marry person of your choice is universal right and it is availbale to every citizen of India. If someone is trying to jepurdize your marriage you can inform the police and file a complaint as this is voilation of human rights. Many bollywood movies have been made around the concept of honor killing to emphasize that marrying by choice is human right under constitution. But keep in mind both of persons marrying should be adults, above the age of 18 years.
  1. Law for live-in relationships
    Right to live-in relationship is a part of right to life and personal liberty guarenteed under Article 21 of the Indian constitution. Line-In relationships are legal in India. If someone in society has a problem with your Live-In relationship, you can seek legal guidence and challenge them in court. Also children born in Live-In relationships are legal children and the respective partners are responsible for taking care of those children. This also means that child born in Live-In relationships have right to enjoy the property of their biological parents.
  1. Rights for Drinking
    Laws for drinking alcohol are different in different states of India. In few states you need be above age of 25 to consume hard dricks. But you can consume alcohol bevarages if you are above 18 years. In few states all kinds of drinks of alcohol are totally banned. If you are drinking and driving make sure alcohol in your blood is not more that 0.03% per 100ml of blood. Well, it is difficult to tell how much alcohol you can have before you can drive but its advisable to say that you should wait atleast 3 to 4 hours after drinking inorder to drive. If you are overdrunk do not drive until you are sober.
  1. Law against stalkers
    Salking can cause mental stress to victim and to prevent that one can take legal action against stalkers and people who harras or threaten. One can file a complaint in the nearest civil court and seek an civil suite of injuction. Through this court will issue an notice to the perpetrator via post, email or even whatsapp and will order to record an consent that he/she will not contact the victim or victim’s family, directly or indirectly untill the matter is settle in court. If the perpetrator tries to contact/harm victim or victim’s family in any manner then he/she will be held responsible and will be put in jail.
  1. The Law against sharing obscene pictures
    Section 67 and 67A of the IT act prohibit publishing or transmitting of the obscene and the sexually explicit material in any electronic form. Section 66E in IT act prohibits capturing, publishing or tranmitting any private area of any person without his/her consent. In circustances where right to privacy is voilated one can be jailed for 3 years and can fined upto 2lakh rupees.
  1. Law against Cyberbullying
    The act of cyberbullying is punishable offense under section 354D for stalking and contacting or stalking a woman. Under section 499, 500 and 503 of IPC for sending defamatory messages via email and any other electronic media is severly punishable. One can reach to crime branch of police and seek help from police in situations of cyberbullying.
  1. The Law for work Leaves
    Perhaps the most needed Indian Law for working professionals which many of us don’t know. Under Apprenticeship act 1961 there should be minimum 12 casual leaves, 15 medical leaves and 10 leaves for other purposes. If these minimum number of leaves are denied by the employeer you can challenge the employer in the court. There are also rules for maximum work hours, schedules and other terms and conditions are also described. This act is made with soul purpose to promote good work life balance. If any organization takes any action that is against the act then one can legally question the organization in the court.
